Terry V Ohio - Case Study Example The detective observed John Terry and Richard Chilton standing on a street corner. They were seen walking back and forth alternately using the same route and stopping to stare at a store in the street. This was done five or six times by each individual leading to a walk up and down the street about twelve times. Each time this walk was over they would pause and talk to each other. During one of these trips in front of the store, a third man joined the two and spoke to them for a brief period before leaving. Identified as Katz, the detective felt this was a set-up for holding up the store, especially when all three individuals rejoined a few blocks away from the store. McFadden then went up to the three men and asked them their names. They were unable to give an answer which created further suspicion in the officer’s mind. The officer quickly reached out to pat the clothes of one of these men during which he came upon a gun in Terry’s overcoat pocket. Reaching inside to remove the gun, McFadden was unable to grasp it and take it out. Thus, he asked Terry to remove the coat itself. This allowed him to take out the revolver. Ordering the men to face the wall with their arms raised the officer was able to check the clothing of the other two men: Katz and Chilton. Chilton too was found carrying a gun. During the pat-down the officer had not been able to find anything on Katz which is why the outer garments of this individual were not checked. Terry and Chilton had been given the same pat-down but upon discovering the weapons., the officer put his hands under their garments to remove the guns. Taking the three men with him to the police station, they were charged with carrying concealed weapons. The defendants of these three individuals then used the seizure and search of the weapons as a violation of the Fourth Amendment. This amendment is part of the Bill of Rights in the United States constitution and protects individuals from irrational seizures and searches. According to this amendment a search warrant has to present to the individual before they can be checked otherwise it will be abusing the law. This warrant also has to be presented by a court that must be given proper reason for its issuing. The importance of this warrant is such that anyone who disobeys it or gives it for an unreasonable cause will also be held accountable in court Thus, under this view the defendants presented their clients as being wrongfully abused by the law. Chief Justice Warren presided over this case and began with the principles established in the Fourth Amendment. The first was that the Fourth Amendment was responsible for protecting people, rather than places and thus gave as much protection to the citizen on the street as to the one at home (Legal Information Institute). Thus, the Court now had to decide whether it was illegal for the officer to check these men without warrant. The problem that arose was the idea of stop and frisk which had occasionally been used by police officers to check suspicious individuals. The problem was that giving the officers so much power without a legal justification could lead to violation of personal security and abuse of authority. David Humes Thoughts On Empiricism Essay One of the most notable figures in the history of western philosophy was Scottish philosopher David Hume. Hume was widely known for his views on Empiricism. Empiricism has been pondered since the beginnings of philosophy by many famous figures, from Aristotle to John Locke. (Wikipedia) Empiricism claims that human knowledge is founded on observation and use of the five senses. Hume published a literary work titled Enquiry concerning Human Understanding. This had a profound impact on empiricist philosophy. (Heter) In section 2 of the Enquiry concerning Human Understanding, titled Of the Origin of Ideas, Hume makes distinctions about impressions and ideas. Simply stating how a memory obtained from the central nervous system can never reach the level of raw, vividness that the original impression had made. An example of this concept can be something along the lines of experiencing free fall. We have all experienced free fall at some point in our lives. Simply recalling that moment can never fully allow us to grasp the gut wrenching excitement of pure gravity. An interesting thought brought forward in section 2 is The Copy Principle. Hume states But though our thought seems to possess this unbounded liberty, we shall find, upon a nearer examination, that it is really confined within very narrow limits, and that all this creative power of the mind amounts to no more than the faculty of compounding, transposing, augmenting, or diminishing the materials afforded us by the senses and real life experience†¦(Enquiry, Section II) In laymans terms, imagination of the human mind might be perceived as limitless. However, in  reality, it is really a combination of sensory information and real life experiences. To this end, Hume believes that there are no truly original ideas. Everything we can conceive is a copy or modification of material afforded to us by our surroundings. Examples of this can be found all around us. Such as the design of a plane matching the shape of a bird or Velcro behaving as burdock burrs. (Bloomberg) An interesting point Hume brings to our attention is the Blind Man Argument. Hume claims that a person born blind has no notions of what color is. If you grant that individual the ability to see, you present him with a new channel for ideas. Without this inlet, he would have no idea what color is. Therefore, color must come from the senses. (Enquiry, Section II) One might object to Humes copy principle by stating that original ideas are created quite frequently. A perfect example of this is the telephone. There was no object in the known universe that was able to transmit encoded sound waves through electrical wire over vast distances to a receiver before the telephone. This invention came into existence through pure innovation. The blind man argument presents an error. Just because a blind man cannot make an association between the word red and the color red doesnt mean that they have never seen it before. Perhaps the man has seen the color red countless times in his dreams. However, without having another individual identify the same color and help him form the association between the word and the color, the blind man will never know what red means. Countering my objection to The Copy Principle, all the natural resources we are afforded on earth  can be combined, transformed or restructured to create something else. Basically, everything we have created can be broken down to the raw materials found within our environment. This makes it impossible to create something truly new. The telephone is simply a combination of oil, copper, aluminum, silicone, ect. In defense of The Blind Man Argument, people born without the ability to see, claim they see nothing. They might understand how the color spectrum works but they will never be able to sense what the actual color looks like. For one to know the answer to this debate, he or she have the ability to see and be blind at the same time. Hume certainly brings up some interesting concepts. For this reason, scholars have been studying his ideas for centuries. Empiricism and rationalism are in constant disagreement. Both philosophical notions are extremely hard to disprove. Aldous Huxley Aldous Leonard Huxley: English novelist, essayist, critic, and poet. On July 26, 1894, Aldous was born of Leonard and Julia Huxley in England. The infamous Huxley family possessed both scientific and literary fame throughout Europe. As a teenage, Aldous developed a bizarre eye disease which left him blind for over two years. The five leading oil-producing countries and their approximate shares of the world supply of oil are: Soviet Union 21%, Saudi Arabia 17%, The United States 15%, Venezuela 4%, and Mexico 4%. These five countries made up 61 % of the worlds oil production back in 1980. Even though The United States is a major producer of oil, it does not make them self-sufficient. The United States uses more oil than they can produce and must look towards foreign countries. An organization called O.P.E.C. controls approximately four fifths of the worlds oil reserves in the non-communist world. The United States is forced to deal with O.P.E.C., not only in its own interests, but also in the interest of its allies and in the interest of maintaining peace. The former Soviet Union may now have an interest in selling some of their oil that they have a tremendous amount of. O.P.E.C. which stands for Organization of Petroleum Exporting Countries, is made up of 13 countries: Iran, Iraq, Kuwait, Saudi Arabia, Venezuela, Qatar, Indonesia, Libya, United Arab Emirates, Algeria, Nigeria, Ecuador, and Gabon. O.P.E.C. was founded in Baghdad, Iraq in September of 1960. It was organized in response to oil producing countries that did not consult with the Middle Eastern oil states before lowering their crude oil prices. The producers feared that other countries would establish monopolies. The aim of O.P.E.C. was to create a universal price between the countries, in order to ensure peace between oil producers throughout the world. Well, I will give you a vivid account of what happened on that day. One of the biggest moments of my life was the day of my graduation. I was walking towards a new beginning in life, a new chapter that filled my body with excitement. At that moment I realized how fast the time had passed by, and that I was no longer a child, but an adult. As the graduation day was an important moment in my life, I must dress up nicely to â€Å"to kill†.I went shopping with my friends to choose some beautiful clothes. I also picked some attractive accessories to put on my clothes. It will give me a nice look during the graduation ceremony. Receiving some card and messages from the friend and relatives, I felt gratified and delighted. They congratulated me for successfully graduating from a prestigi ous university. Besides encouraging me to chase my dream, they also wished me to be successful in my new chapter of life. The day of graduation finally arrived. I woke up early to go get my hair, nails, and make up ready for the big day. I dressed up in a purple and red robe.I was on cloud nine when Professor Tan said that I was dressed â€Å"to kill†. In Shakespeare's "Merchant of Venice", Shylock, the `villain' is portrayed as the other simply because of his faith, because he is Jewish in a predominantly Christian society. One way that Shylock is classified as the other was by being stripped of his name. Throughout the play, Shylock was very seldom referred to by name; in the trial scene, the Duke identifies him by name twice, and Portia does so once. During the rest of the play, Shylock is usually referred to as "the Jew", "dog Jew" (II, viii, 14), and "currish Jew" (IV, i, 292) Throughout the play, Shylock was often reduced to something other than Human. In many cases, even the simple title of "Jew" was stripped away, and Shylock was not a man, but an animal. For example, Gratiano curses Shylock with "O, be thou damned, inexecrable dog!" (IV, i, 128) whose "currish spirit govern'd a wolf" (IV, i, 133-134) and whose "desires are wolvish, bloody, starved, and ravenous" (IV, i, 137-138). Or when Shylock is neither a man nor an animal, he becomes "a stony adversary, inhuman wretch" (IV, i, 4-5). When the Christians applied these labels to Shylock, they effectively stripped him of his humanity, of his religious identity; he was reduced to something other than human. The Christians also labeled Shylock as explicitly equated with the Devil, which in a primarily Christian society left Shylock as the other. For example, in (II, ii, 24-28), Launcelot Gobbo identifies Shylock as "a kind of devil", "the devil himself", and "the very devil incarnation." Shylocks own daughter compared Shylock's house to "hell" (II, iii, 2). Salanio identifies Shylock as "the devil...in the likeness of a Jew" (III, i, 19-21) and Bassanio echoes this sentiment by identifying Shylock as a "cruel devil" (IV, i, 217). Antonio further cements the association between Shylock and the devil by noting how Shylock's arguments remind him how "The devil can cite scripture for his purpose" (I, iii, 97-100).
